Basically, shit happened. I fear I'll grow old before this issue resolves. 
But SM is so full of shit it's actually funny.
On the issue of the Net Profit of 14.7 billion KRW (approximately 14.7 million USD) in 2008:
SM: Of that, the portion from TVXQ was only 1 billion KRW. The rest came from BoA, CSJH, and The Trax.
JYJ’s law firm: Wow, so CSJH must make more money in Japan than TVXQ!
